Policies That Apply to You

These General Terms and Conditions work together with the following policies. All of them form part of the agreement between you and us:

Please read all relevant policies before making a purchase or booking a service. By using Our Website, you agree to be bound by all of these policies. If you do not agree, please do not use Our Website.

Changes to These Terms

We may update these Terms at any time at our sole discretion. Updated Terms will be posted on this page with a new “Last updated” date. Changes do not apply to orders or bookings already confirmed before the change was made. We will try to give you reasonable notice of major changes where possible.

It is your responsibility to check these Terms regularly. Continued use of Our Website after changes are posted means you accept the updated Terms.

Changes to Our Website

We may update, change, or remove any content from Our Website at any time without notice. We may also temporarily or permanently suspend all or part of Our Website without notice and will not be liable for any resulting inconvenience.

Accessing Our Website

Our Website is generally available free of charge, although fees may apply for specific products and services. We do not guarantee the Website will be available at all times or free from errors.

You are responsible for your own internet access and all costs associated with it. You must ensure that anyone using Our Website through your account or connection is also aware of and complies with these Terms.

You must be at least 18 years of age to use Our Website independently, or at least 13 years old with a parent or guardian’s consent. We do not knowingly collect information from or provide services to anyone under 13.

Your Account and Password

If you create an account with us, you are fully responsible for keeping your login details confidential and secure. You must not share your username or password with anyone else. If you think someone has accessed your account without your permission, contact us immediately at [email protected].

We may disable or close any account at any time if we believe it has been used in breach of these Terms, or if it has been inactive for an extended period. You may not transfer your account to another person without our prior written consent.

Ordering and Payment

When you place an order through Our Website, you are making an offer to purchase. We reserve the right to accept or decline any order at our discretion. Your order is confirmed only once we send you written confirmation (usually by email).

Pricing: All prices are shown in New Zealand Dollars (NZD) and include GST unless stated otherwise. Prices may change at any time before your order is confirmed.

Payment: Full payment is required at checkout unless other terms have been agreed in writing. We accept major credit and debit cards and other payment methods shown at checkout. We are not responsible for any fees your bank or card provider charges you.

Consumer Rights — Consumer Guarantees Act 1993

If you are buying our goods or services for personal, domestic, or household use, the Consumer Guarantees Act 1993 (“CGA”) applies. This means our goods and services come with automatic guarantees, including that:

  • Goods are of acceptable quality — safe, durable, free from defects, and fit for the purpose they are sold for
  • Goods match their description
  • Repair and other services are carried out with reasonable care and skill
  • Services are completed within a reasonable time
  • Services are fit for any specific purpose you told us about before booking

If we fail to meet these guarantees, you have the right to a remedy. Depending on the failure, this may include a re-do of the service, repair, replacement, or full refund. For a major failure, you may reject the goods or service and choose a full refund or replacement.

Business purchases: If you purchase our products or services for business purposes, you agree that the Consumer Guarantees Act 1993 does not apply, to the extent permitted by section 2(1) of the CGA.

Fair Trading Act 1986

We comply with the Fair Trading Act 1986 and will not engage in misleading or deceptive conduct. All product descriptions, service information, and pricing on Our Website are intended to be accurate. If you believe any information is misleading, please contact us immediately so we can correct it.

Privacy and Your Personal Information

We are committed to protecting your personal information under the Privacy Act 2020 (New Zealand). We collect only what is needed to process your order, provide our services, and improve your experience. We will not sell your personal information to anyone. For full details, see our Privacy Policy.

Intellectual Property

All content on Our Website — including text, images, logos, graphics, and code — is owned by or licensed to NZ Tech Ltd and protected by New Zealand and international copyright laws. You may save or print content from Our Website for your own personal, non-commercial use only. Commercial use of any content without our prior written consent is prohibited. Our name “NZ Tech” and our logo are trade marks of NZ Tech Ltd.

No Reliance on Information

Content on Our Website is provided for general information only. It is not intended as professional advice (legal, financial, technical, or medical). You should seek independent professional advice before making any decision based on content found on Our Website. We make no guarantee that information on Our Website is always accurate, complete, or up to date.

Third Party Links

Our Website may include links to third party websites. These are provided for convenience only. We have no control over the content of those sites and are not responsible for any loss or damage you may experience by using them. A link from Our Website does not mean we endorse or recommend the linked website.

Limitation of Liability

To the maximum extent permitted by New Zealand law, we exclude liability for any indirect, special, or consequential loss or damage arising from use of Our Website or from our products or services (including but not limited to loss of data, lost profits, or business disruption). Our total liability for any claim is limited to the amount you actually paid us for the relevant product or service.

Nothing in these Terms excludes or limits any liability that cannot be lawfully excluded under the Consumer Guarantees Act 1993, the Fair Trading Act 1986, or any other applicable law. Where such mandatory rights apply, our liability is limited to the minimum extent the law allows.

Events Outside Our Control (Force Majeure)

We will not be liable for any failure or delay in performing our obligations where that failure is caused by events beyond our reasonable control, including but not limited to natural disasters, power outages, pandemics, cyberattacks, extreme weather, or government action. We will notify you as soon as reasonably possible and work to resume normal service quickly.

Suspension and Termination

We may suspend or terminate your access to Our Website or any account at any time, without notice, if we believe you have breached these Terms or engaged in conduct that may harm us, other users, or third parties. We may also take legal action where appropriate and will report criminal conduct to the relevant New Zealand authorities.

Subcontracting

We may use trusted third party contractors or suppliers to assist in delivering our products or services. We remain responsible to you for the standard of those products or services. We take reasonable steps to ensure any subcontractors meet our quality standards.

Confidentiality

Any non-public information about our business, pricing, methods, systems, or suppliers that you become aware of through your dealings with us is confidential. You must not disclose or use this information without our written consent, except where required by law.

Entire Agreement

These Terms, along with all linked policies on Our Website, form the entire agreement between you and us and replace any prior agreements or understandings. We will only be bound by variations that are agreed in writing.

Severance

If any part of these Terms is found to be invalid or unenforceable, it will be modified to the minimum extent needed, or removed, without affecting the rest of these Terms.

Waiver

If we do not enforce any part of these Terms on a particular occasion, that does not mean we give up our right to enforce it later. Any waiver must be made in writing by us to be effective.

Assignment

We may transfer our rights and obligations under these Terms to another party at any time and will notify you if this occurs. You may not transfer your rights or obligations to anyone else without our prior written consent.

Governing Law

These Terms are governed by the laws of New Zealand. Any dispute arising from these Terms or your use of Our Website is subject to the exclusive jurisdiction of the New Zealand courts. We encourage you to contact us first to resolve any issue before taking formal legal action.
